Introduction
Augmum, Inc. ("Augmum Robotics," "we," "our," or "us") provides a website with an online store (the "Store") on its website to allow you to buy products offered through our website ("Products"). By buying a Product from the store, you consent to these Terms and Conditions of Sale ("Terms of Sale") together with any related terms that we may provide associated with such purchase, including, but not limited to, the Augmum Robotics Terms of Service available, and the limited license included in the product ("Limited Warranty").
Any software programmed in the product (including any updates to it) is licensed, not sold, and Augmum Robotics' End User License Agreement will govern your access to and use of such software.
This end user license agreement is a legal and binding agreement. by placing an order for augmum products, you are accepting and agreeing to these terms of sale. you represent and acknowledge that you have the right, authority, and capacity to accept and agree to these terms of sale. you acknowledge that you are of appropriate legal age in your residence or jurisdiction to buy and utilize augmum robotics products and to enter into this contract. please read these terms of sale carefully and agree with all the provisions of these terms of sale, otherwise, you should not purchase the products.
This binding agreement requires the use of obligatory settlement to address disputes rather than resort to class actions suits or jury trials. Read "Applicable Law and Dispute Resolution" below for more information.
These Terms of Sale give you detailed legal rights, which vary from jurisdiction to jurisdiction. The limitations, disclaimers, and exclusions of liability stated in these Terms of Sale will not apply to the extent prohibited by existing law. Some administrations do not allow the exclusion of implied warranties or the limitation or exclusion of consequential or incidental ruin or other rights, forfeiting your claim in the provisions of these Terms of Sale. In the case of information irregularities between these Terms of Sale and data included in any other materials about the Products (e.g., advertising materials and mailers), these Terms of Sale will always administer and take superiority.
Availability and Cancellations. All Products presented in the store are subject to availability. We have the right to impose restrictions on any order or request to reject all or part of an order and discontinue offering certain Products without prior notice. Augmum Robotics reserves the right to decline, refuse, or cancel any order for any reason at any time before the product delivery or after a product order has been made, be it a confirmed order or not. We will try to reach out to you if a part or all of your order is canceled or needed additional information to accept and complete your order.
1: Pricing and Payment.
Product prices are subject to change at any time. However, price changes will not affect any order for Products you have already placed. By providing your credit card details or other payment methods accepted by Augmum Robotics, you assure that you are approved to use the selected payment methods and that you authorize Augmum (or our third-party payment partners) to charge your payment method for the total amount of your order request (including any applicable taxes and other fees). You will provide Augmum Robotics with precise and complete billing information, including legal name, current address, contact number, credit or debit card billing information. Augmum Robotics reserves the right to terminate your order request in case of fraudulent or false information and to seek any other legal remedies that may be necessary.
Augmum Robotics is not responsible for any fees, expenses, or charges (e.g., for exceeding credit card limits, overdrawn accounts, etc.) resulting from charges billed by Augmum Robotics. Each cost will be considered valid unless you disputed in writing within thirty (30) days after the billing date; after that, no amendments will be honored. All fees will be paid in the U.S. dollar currency and are due set forth on the Sites. Augmum Robotics' prices are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you will be accountable for payment of all such taxes, duties, or levies, excluding only United States (state or federal) taxes based solely on Augmum Robotics' income. Suppose you want to change or update payment information associated with your Augmum Robotics account. In that case, you can do so at any time by logging into your account and editing your payment information.
2: Reservations and Preorders.
Products available for reservation and preorder are not offers for sale by Augmum Robotics. Your placement of a reservation and preorder does not create a contract for sale. By placing a reservation and preorder for a Product that is not yet available for purchase, you make an offer to Augmum Robotics to buy the product subject to these Terms of Sale. You may terminate your offer to purchase Products at any time before shipment, and you will not be charged. When the product is offered for sale, Augmum Robotics may accept your offer to purchase Products subject to these Sale Terms. At that time, Augmum Robotics will capture payment on the payment method you provided and at or after the suitable date on the order ship your product. Augmum Robotics may obtain further authorization from your payment card company to authenticate necessary funds are accessible to buy the requested Products.
3: Resale and Title Transfer.
Purchases made in the store are set for End-Users only and are not allowed for resale. Title for Products bought from the store passes to the purchaser at the time of delivery by Augmum Robotics to the freight carrier. Still, Augmum Robotics and/or the freight carrier will be responsible for any Product loss or damage that occurs when the product is on its way to you.
4: Shipping and Delivery.
Prices for the Products do not include freight costs. Our delivery methods and charges are as expressed on the Store website from time to time. The projected arrival or delivery date is not a specific delivery date of your placed order. Refused deliveries will be restored to our warehouse. It may take up to 30 - 45 days for the returned items to be tagged as "refused" and processed for a refund.
Although the store is accessible worldwide, its products are not designed and tested for all countries. To the extent permissible by law, Augmum Robotics accepts no liability or accountability for any damage, loss, or expense caused by your access, purchase, delivery, or use of the Store or Products outside the United States and Canada. You are solely accountable for fulfilling all applicable regulations and protocols of the country for which the product is intended. We will not be held answerable or liable if you break any of such laws. All safety warnings, instructions, information, packaging, in-box materials, mobile apps, and support services are provided in English (though Augmum Robotics may choose to make the same available in additional languages as Augmum Robotics deems appropriate in its sole discretion).
Returns :
Suppose, for any reason; you want to return the product you bought from the store that has been delivered to you for a refund. In that case, you must notify Augmum Robotics customer support no later than 60 days after the date of acquisition (whichever is later) (the "Cancellation Period"). State your desire clearly to return the product and, if bought and shipped directly from us, your agreement to any related top-up fees. Although it will not affect your right to repayment, please take account of details on where and when you bought the product and your reason for returning the product. Augmum Robotics customer service will provide you with a Return Materials Authorization ("RMA") that must be included with your return shipment to Augmum Robotics. Augmum Robotics will identify your freight and with a return address. To be eligible for repayment, you must return your product (also any promotional products supplied with the product) with an RMA within the fourteen (14) days following the day you notify Augmum Robotics customer support of your request to return your product. Unless the product is defective or not described, you will handle all costs related to returning the product to us. We will pay back the amount you paid for the product plus the initial delivery cost (up to the value of our on-ground delivery option), less the value of any restocking fees, promotional merchandise, or discounts you received. Augmum Robotics will process the due refund as soonest date possible and, in any case, within thirty (30) days from the date that Augmum Robotics received the returned product. After 30 days, the product is no longer refundable.
Warranties and Disclaimers:
The store and all content presented in connection with the store are provided on an "as is" and "as available" basis and devoid of any guarantees. All Products bought through the store are provided on an "as-is" basis unless otherwise noted in the Limited Warranty. For Products, you may choose whether to claim the Limited Warranty or these Terms of Sale or both, but you are not allowed to recover twice in respect of the same loss. Except as specifically stated in the limited warranty, augmum robotics disclaims all warranties, whether express or implied, concerning the store or products, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose and non-infringement. No advice or information given by augmum robotics, its employees or affiliates shall create a warranty.
Limitation of Liability :
To the full degree allowed by applicable statute, in addition to the warranty mentioned above disclaimers, in no case, will (a) augmum be responsible for any conditional, punitive, exemplary, exceptional, or incidental damages, including any defects for missing data or lost revenues, arising from or relating to the goods, even though augmum recognized or should have learned of the likelihood of such damages, (b) the complete cumulative liability of augmum emerging or related to the goods, whether it be in agreement or claim or otherwise, surpass the payments paid by the user to augmum for the service or product at issue in the previous six (6) months (if any). this term for limitation is collective and hence, not increased by the presence of more than one event or potential argument. augmum denies being responsible for any of augmum's promises and suppliers. it is the intent of you and pug mum that this provision of the product shall get analyzed by a suitable authority as being the broadest limitation of such liability in accordance with applicable law. a few legal authorities may not allow the prohibition or elimination of incidental, unintentional, or any other forms of damages. hence, some of the limitations mentioned above do not extend or may apply to you. none of these terms and in specific, within the "limitation of liability" provision shall seek to prohibit liability that cannot be kept out from exclusive rules under the applicable law.
Protection of data:
By purchasing the Products section of the website, you acknowledge and accept that Augmum can store, exchange, process, and then use the data gathered from your order form for the intent of completing the transaction. Augmum will safeguard the details in compliance with the Privacy Policies accessible. Augmum collaborates with partnered businesses that help our company distribute goods to you, including trucking companies and payment processing organizations. Augmum may need to exchange some details with these firms for this sole purpose.
Electronic networking:
You communicate remotely through electronics and technology with Augmum. At the same time, you use the Shop or send an email to prompt your order requests. You accept that all contracts, announcements, disclosures, and other correspondence sent to you electronically satisfy and fulfill any obligation that all information exchange shall appear in writing. GENERAL

In that case, Augmum is in charge of settling the dispute exclusively under the American Arbitration Association (www.adr.org) at its office located in Denver, Colorado. Any move or attempt to adjudicate the said action by one party will be final and shall bind on the other.
IN AGREEING TO THIS TERM, YOU HAVE FULLY UNDERSTOOD THAT EITHER PARTY THAT ELECTS TO ADJUDICATE RESULTS TO NEITHER PARTIES TO HAVE THE CAPABILITY AND RIGHT TO SUE IN LEGAL JUSTICE OR CONDUCT A JURY TRIAL. YOU AND AUGMUM AGREE THAT ANY ARBITRATION OF SUCH ACTION SHALL LIMIT THE DISPUTE BETWEEN YOU AND THE COMPANY. YOU ACKNOWLEDGE AND ADHERE TO THE STATEMENT THAT YOU AND AUGMUM WAIVES THE RIGHT TO COOPERATE AND PARTICIPATE AS A COMPLAINANT OR CLASS MEMBER IN ANY PROFESSED CLASS ACTION OR ANY REPRESENTATIVE PROCEEDINGS.
Furthermore:
Unless you and Augmum have otherwise agreed in writing, an adjudicator may not amalgamate more than an individual's claims or otherwise conduct over any class or representative proceeding. Irrespective to any statute to the contrary, whatever claim or cause of such action that arose connected to or as a result of using of the Services of the Terms of Sale should get brought, if possible, within a year from the accruement of the claim or cause of concern or be barred forever. Not siding the preceding, Augmum may be able to seek an order or any other equitable acts to relieve and protect its confidential data and intellectual company rights, as well as prevent any loss of vital information and damage to its servers in any legal location of competent jurisdiction. Location Limitations:
Although Augmum's store can be freely accessed by individuals worldwide, its products and services do not intend allowable usage in all countries where they can access its website. Suppose you prefer to get in the store and use the Products section and Subscription Services outside the company's country of origin, as applicable. In that case, you should then do such action in your initiative and agree that you are solely held accountable for complying with applicable law in your locality or country. Augmum will not be held responsible or liable for any deformation or loss caused by your access or use of the Store section in the websites of Products given by a non-target state to the extent allowed by the law.
Notifications and updates :
Augmum may send alerts, updates, and messages to you as needed by regulation or for promotional or other reasons by the primary email attached with your Augmum Account, a copy attached, or postings of the said updates on the Augmum site. Augmum is not accountable for any automated filtering that you or your core network service might use for email alerts.
Vis major :
Augmum shall not be held liable for any inability or delay in the efficiency of its responsibilities arising from strikes, scarcities, riots, insurrections, fires, floods, storms, explosions, natural occurrences, war, state intervention, labor conditions, earthquakes, resource limitations or any other cause far beyond the reasonable control of Augmum.
Waiver :
Augmum's inability to implement any privilege or condition in these Terms of Sale shall not affect a waiver of such provision or right until it has been recognized and acknowledged in writing by Augmum.
Construction :
The titles of the Sections of the Terms of Sale shall be for designed ease and convenience on both the company and customers; and shall not be used for interpretation purposes.
Indefatigability :
Sections 8 up to 11 of these terms and conditions will survive the expiry or termination of Sale's Terms.

COMPREHENSIVE AGREEMENT. Such Terms of Sale represent the whole arrangement for both you and Augmum Robotics regarding the Facilities, overriding any previous agreement between you and Augmum Robotics. Augmum Robotics' refusal to enforce or execute any right or provision under these Terms of Sale shall not affect the right or provision. If a competent jurisdiction considers any clause of these Terms of Sale to be unconstitutional, you and Augmum, however, accept that the tribunal should strive to give effect to the interests of the parties as set out in the term, such that the other clauses of these Terms of Sale remains entirely following the agreement.
